Please read these Terms and Conditions carefully before using the SigmaForge platform. By accessing or using our website, services, or applications, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, enrolling in a course, accessing any SigmaForge platform feature, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a legally binding agreement between you and SigmaForge Inc., a Delaware corporation. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Services Provided

SigmaForge provides an AI-powered Operational Excellence platform. Our Services are organized around three delivery pillars:

  • Individuals (B2C): Self-serve certification programs and AI-guided training, including White Belt, Yellow Belt, Green Belt, and Black Belt pathways accessible via individual subscription or one-time purchase.
  • Teams & Enterprise (B2B): Annual recurring licenses, executive dashboards, roll-up analytics, and team ROI tracking designed for corporate workforce development at scale.
  • Academic Institutions: Collaborative curriculum licenses enabling universities and academic programs to integrate industry-aligned Lean Six Sigma certification into accredited degree and professional development programs.

The specific features and tools available to you depend on your selected tier and any applicable enterprise or academic agreement.

3. Definitions

For the purposes of these Terms:

  • Company,” “we,” “us,” or “our” refers to SigmaForge Inc., a corporation incorporated in the State of Delaware.
  • Platform” refers to the SigmaForge website, web applications, mobile applications, AI tools, and all related services accessible at www.sigmaforge.ai.
  • Services” means all products, courses, certifications, AI tools, and features offered by SigmaForge including but not limited to SigmaTutor, PathForge, DataForge, CertiAI, ImpactMatrix, and related enterprise tools.
  • User,” “you,” or “your” refers to any individual or entity accessing or using the Platform.
  • Content” means all text, video, audio, software, data, assessments, project templates, AI-generated outputs, and other materials available through the Platform.
  • Subscription” means a recurring billing arrangement granting access to specified Services for a defined period.
  • Certification” refers to a SigmaForge-issued certificate of completion aligned to Lean Six Sigma Bodies of Knowledge.

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at info@sigmaforge.ai.

4.3 Eligibility

You must be at least 18 years of age to create an account and use our Services. By registering, you represent that you meet this age requirement. Our Services are not directed to individuals under 18.

5. Subscriptions, Purchases, and Billing

5.1 Free Tier

SigmaForge offers a free tier with limited access to platform features. Free tier access may be modified or discontinued at any time at our sole discretion with reasonable prior notice to affected users.

5.2 Paid Subscriptions

Certain features require a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) at the rates displayed at the time of purchase. You authorize SigmaForge to charge your payment method on a recurring basis until you cancel your subscription.

5.3 One-Time Course Purchases

Individual course purchases grant you a non-transferable, non-exclusive license to access that course content for personal, non-commercial use. Access duration will be specified at the time of purchase.

5.4 Corporate and Enterprise Invoicing

Enterprise and corporate clients may be invoiced pursuant to a separate written agreement. Payment terms, seat licenses, and service levels will be governed by the applicable enterprise agreement. In the absence of such an agreement, standard payment terms are net 30 from invoice date.

5.5 Pricing Changes

We reserve the right to modify pricing at any time. For active subscriptions, pricing changes will take effect at the next renewal period following 30 days advance notice via email.

5.6 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, VAT, GST, or similar taxes applicable to your purchases.

6. Refund Policy

6.1 Subscription Refunds

Annual subscriptions may be refunded within 14 days of initial purchase if no course content has been accessed. Monthly subscriptions are non-refundable once the billing period has commenced.

6.2 Course Purchase Refunds

One-time course purchases are eligible for a full refund within 7 days of purchase under our satisfaction guarantee, provided no more than 25% of the course content has been accessed. Refunds will not be issued for courses that are substantially completed or where the 7-day window has expired.

6.3 Corporate Accounts

Refund terms for enterprise and corporate accounts are governed by the applicable enterprise agreement. In the absence of such terms, refund requests must be submitted in writing within 30 days of purchase.

6.4 How to Request a Refund

To request a refund, contact us at info@sigmaforge.ai with your order details. Approved refunds will be processed within 7 to 10 business days to the original payment method.

7. Intellectual Property

7.1 Our Content

All Content on the Platform, including but not limited to course materials, AI-generated outputs, software, text, graphics, logos, assessments, project templates, and video content, is the exclusive property of SigmaForge Inc. or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

7.2 License to Users

Subject to your compliance with these Terms, SigmaForge grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its Content solely for your personal, non-commercial educational purposes.

7.3 Prohibited Uses

You may not, without our express written permission:

  • Copy, reproduce, distribute, or create derivative works from our Content
  • Use our Content for commercial purposes, resale, or redistribution
  • Scrape, crawl, or use automated tools to extract data from the Platform
  • Reverse engineer, decompile, or disassemble any software component of the Platform
  • Remove or alter any copyright, trademark, or proprietary notices
  • Share your account credentials or course access with third parties
  • Use our Platform or AI tools to train competing AI models or services without express written consent

7.4 Your Content

By submitting any content to the Platform (including project submissions, forum posts, or feedback), you grant SigmaForge a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute such content for the purpose of operating and improving the Platform.

7.5 AI-Generated Outputs

Content generated by SigmaForge AI tools (including SigmaTutor, DataForge, and related tools) is provided for educational and informational purposes only. SigmaForge retains all intellectual property rights in the underlying models, algorithms, and systems.

8. Certifications and Accreditation Disclaimer

SigmaForge issues certificates of completion aligned to the Bodies of Knowledge (BoK) of globally recognized certification agencies. The following important limitations apply:

  • SigmaForge certifications are NOT official certifications issued by, affiliated with, or accredited by ASQ, CSSC, IASSC, IQF, or ISO.
  • SigmaForge certificates demonstrate completion of curriculum aligned to these Bodies of Knowledge and do not confer membership in or endorsement by those organizations.
  • Users seeking official ASQ, IASSC, or other body-issued certifications must apply directly to those organizations and independently satisfy their requirements.
  • SigmaForge reserves the right to revoke certifications in cases of academic dishonesty, fraud, or material violation of these Terms.

9. AI Tools and SigmaTutor™ Disclaimer

9.1 AI-Powered Platform

SigmaForge’s platform incorporates advanced artificial intelligence tools, including SigmaTutor™, PathForge™, DataForge™, CertiAI™, ImpactMatrix™, and others (collectively, “AI Tools”). These tools provide 24/7 coaching, automated project auditing, adaptive learning pathways, and real-time statistical feedback trained on Master Black Belt standards.

9.2 Accuracy Disclaimer

While SigmaForge AI Tools are developed and trained to Master Black Belt standards, SigmaForge does not guarantee that AI-generated suggestions, evaluations, or outputs are error-free, complete, or suitable for any specific operational application. Users are solely responsible for the final validation of all statistical analysis, project data, and improvement recommendations before implementation in any organizational or operational context.

9.3 No Professional Advice

Nothing generated by SigmaForge’s AI Tools constitutes professional engineering, quality, operational, legal, financial, or medical advice. AI outputs are educational aids only. Always engage qualified professionals before implementing process changes with material operational, financial, or safety implications.

9.4 Enterprise B2B Use

Enterprise customers using SigmaForge’s B2B automation frameworks for operational data analysis are responsible for ensuring their use complies with all applicable industry regulations. Where the platform processes data subject to HIPAA, ISO standards, or other regulated frameworks, the enterprise customer is solely responsible for ensuring its own compliance obligations are met.

10. Acceptable Use Policy

You agree not to use the Platform to:

  • Violate any applicable local, state, national, or international law or regulation
  • Engage in academic dishonesty, including sharing assessment answers or impersonating another user
  • Harass, threaten, defame, or harm other users or SigmaForge personnel
  • Upload or transmit malicious code, viruses, or disruptive data
  • Attempt to gain unauthorized access to any portion of the Platform or its related systems
  • Make false or misleading statements about your identity, qualifications, or affiliation
  • Engage in any activity that unreasonably burdens or disrupts the Platform infrastructure

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

11. Third-Party Services and Payments

The Platform may contain links to or integrations with third-party websites, tools, and services. SigmaForge is not responsible for the content, privacy practices, or availability of third-party services. Payment processing is handled by third-party payment processors. SigmaForge does not store your full credit card or payment information on its servers.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SIGMAFORGE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIGMAFORGE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SIGMAFORGE’S TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12.3 Professional Advice Disclaimer

Content provided through the Platform is for educational purposes only and does not constitute professional, legal, medical, financial, or operational consulting advice. Always consult qualified professionals for specific decisions.

13. Indemnification

You agree to indemnify, defend, and hold harmless SigmaForge Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Platform; (c) your submitted content; or (d) your violation of any third-party rights.

14. Termination

14.1 By You

You may terminate your account at any time by contacting us at info@sigmaforge.ai. Termination does not entitle you to a refund except as described in our Refund Policy.

14.2 By SigmaForge

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for violations of these Terms, fraudulent activity, or conduct harmful to other users or the Platform.

14.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before filing any formal legal claim, you agree to contact SigmaForge at info@sigmaforge.ai and attempt to resolve the dispute informally for a period of 30 days.

15.3 Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Wilmington, Delaware, or virtually if agreed by both parties.

15.4 Class Action Waiver

YOU AND SIGMAFORGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.5 Exceptions

Either party may seek emergency injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

16. Changes to Terms

SigmaForge reserves the right to modify these Terms at any time. We will notify you of material changes via email or prominent Platform notice at least 30 days before changes take effect. Continued use after changes become effective constitutes acceptance of the revised Terms.

17. Miscellaneous

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and SigmaForge regarding your use of the Platform.
  • Severability: If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign these Terms without our prior written consent. SigmaForge may assign these Terms freely.
  • Force Majeure: SigmaForge shall not be liable for delays or failures resulting from causes beyond its reasonable control.
